El CCT 40/89 en las cláusulas 6.1.6 y 3.3.2 contiene reglas especificas para la liquidación del salario vacacional de los trabajadores comprendidos en su ámbito de aplicación.

La cláusula 6.1.6. estipula la aplicación del divisor 24 al sueldo mensual del trabajador “a todos los efectos legales y convencionales”, lo que incluye, lógicamente, la licencia anual, apartándose así de lo previsto en el Art. 155 inc. a) de la LCT, que dispone la aplicación del divisor 25 para el calculo del adelanto vacacional para los trabajadores remunerados sobre la base de sueldo.

La cláusula 3.3.2. expresamente obliga al empleador a ajustar el adelanto vacacional que hubiera liquidado, en el supuesto de que se produzcan incrementos salariales durante la licencia. Si bien esa también es la interpretación jurisprudencial predominante del Art. 155 de la LCT, el texto del inciso a) de ese articulo, aplicable a los trabajadores remunerados a sueldo, únicamente dice que la retribución vacacional se liquidara conforme “el importe del sueldo que perciba en el momento de su otorgamiento”, con lo que, en comparación, la cláusula convencional establece una regla clara de aplicación que elimina cualquier duda interpretativa.

Finalmente, debe recordarse una reciente modificación de esta cláusula.

El acuerdo colectivo de fecha del 30/03/2011, homologado por Resolución de la Secretaria de Trabajo 420/2011 del 10/5/2011 le agrego un párrafo que prevé el pago de un adicional fijo por cada día de la licencia de vacaciones que debe sumarse al adelanto vacacional cuya liquidación hemos indicado antes.

EL adicional mentado (cuyo monto vigente es de $ 69) deberá actualizarse conforme a los incrementos de remuneraciones básicas, ya sea estas por porcentaje o por montos fijos, con el mismo porcentual resultante del incremento del sueldo básico del Chofer de Primera Categoría.
