Aportes y contribuciones al Sistema de Obras Sociales. Remuneración mínima imponible. Normas aplicables.

El presente es el primero de dos comentarios sobre el tema y esta referido a las normas que regulan la base de calculo de los aportes y contribuciones con destino al Sistema de Obras Sociales.

El tercer párrafo del Art. 18 de la Ley 23.660 establece que los aportes y contribuciones deberán calcularse para los casos de jornadas reducidas de trabajo, sobre una base mínima igual a ocho horas diarias de labor calculadas conforme a la categoría laboral del beneficiario titular y en base al convenio colectivo de trabajo de la actividad de que se trate, aplicándose sobre veintidós (22) días mensuales de dicha jornada mínima, para el personal jornalizado.

Para el personal mensualizado, los aportes y contribuciones mínimos serán calculados sobre las remuneraciones establecidas en los convenios colectivos de trabajo para la actividad y de acuerdo a la categoría laboral del trabajador, en base a la cantidad de doscientas horas mensuales, salvo autorización legal o convención colectiva de trabajo que permita al empleador abonar una retribución menor.

El Art. 92 ter de la LCT define al contrato de trabajo a tiempo parcial como “aquel en virtud del cual el trabajador se obliga a prestar servicios durante un determinado número de horas al día o a la semana, inferiores a las dos terceras (2/3) partes de la jornada habitual de la actividad”. Precisando que en ese caso “la remuneración no podrá ser inferior a la proporcional, que le corresponda a un trabajador a tiempo completo, establecida por ley o convenio colectivo, de la misma categoría o puesto de trabajo”. El apartado 4, segundo párrafo de ese articulo prescribe que “Los aportes y contribuciones para la obra social serán la que corresponda a un trabajador, de tiempo completo de la categoría en que se desempeña el trabajador”.

La Resolución Conjunta

(MTSS-MSAS) 105-94 del año 1996 dispone que están comprendidos en el régimen de jornada reducida de trabajo a aquellos trabajadores jornalizados de la ley 22.250 cuyas horas totales trabajadas en un periodo mensual no superen la cantidad de 176 (ciento setenta y seis) horas, independientemente de la extensión horaria de cada jornada.

El Art. 8 del Decreto 492/95 dispone que “El trabajador a tiempo parcial cuya remuneración sea inferior a TRES (3) MOPRES, podrá optar por los beneficios de obra social, integrando el aporte a su cargo y la contribución del empleador con más los porcentajes que correspondan al Fondo Solidario de Redistribución, correspondientes a un salario de TRES (3) MOPRES. Cuando no se ejerza la opción antes indicada, el trabajador y el empleador quedarán eximidos de sus respectivos aportes y contribuciones”.

El Art. 9 de ese decreto prevé que “Cuando el trabajador a tiempo parcial se desempeñare en relación de dependencia para más de un empleador y la suma de sus remuneraciones fuere igual o superior a TRES (3) AMPOs, la unificación de aportes y contribuciones se hará según lo establecido por el artículo 9 del Decreto N. 292 del 14 de agosto de 1995. Cuando la suma de las remuneraciones resultare menor a TRES (3) AMPOs, se aplicará el artículo anterior”.

El Art. 13 de la Ley 26.417 sustituyo todas las referencias al Módulo Previsional (MOPRE) existentes en las disposiciones legales y reglamentarias, que han sido reemplazadas por una determinada proporción del haber mínimo garantizado que es actualizada por la ANSeS en los meses de marzo y septiembre de cada año a fin de actualizar las prestaciones del sistema previsional.

El Decreto 488/2011 (B.O. 27/4/2011), Art. 1º, dispuso que para el cálculo de los aportes y contribuciones de obra social en los términos de las Leyes Nº 23.660 y Nº 23.661, se tomará como base el equivalente a CUATRO (4) bases mínimas de las previstas por el artículo 7º de la Resolución Nº 135/09 de la ANSeS o la que la reemplace en el futuro, es decir $ 1708,24.-. dado que desde el 01/03/2011, esa base mínima fijada por la ANSeS es de $ 427,06.- (Art. 7 Res. ANSeS 58/2011).

LABORAL

Aportes y contribuciones al Sistema de Obras Sociales. Remuneración mínima imponible. Una interpretacion de las normas aplicables.

En base a las normas indicadas en el comentario anterior, interpretamos que son aplicables las siguientes pautas.

1) Si, en el supuesto de jornada reducida o contrato de tiempo parcial la remuneración devengada en el periodo mensual supera $ 1.708,24.- será aplicable la base imponible para el calculo de aportes y contribuciones que prevén los Art. 18 de la Ley 23.660, 92 ter de la LCT y 1 de la RC MTSS-MSAS, es decir, el salario convencional o el mínimo vital, según el caso, de jornada completa.

2) En el supuesto de contrato de trabajo a tiempo parcial, con remuneración mensual devengada inferior a $ 1.708,24.- conforme a lo previsto en el Art. 8 del Decreto 492/95, el trabajador podrá ejercer alguna de estas opciones: a) No gozar de los beneficios de Obra Social, en cuyo caso trabajador y empleador quedaran eximidos del pago de aportes y contribuciones con ese destino o b) Gozar de los beneficios de la Obra Social, en cuyo supuesto el trabajador integrara el aporte a su cargo y se hará cargo de la contribución del empleador con más el porcentaje de contribución patronal aplicable sobre la diferencia entre el salario devengado y la base mínima antes indicada. Cualquiera fuere la opción que ejerza el trabajador, es recomendable que el empleador le requiera que la formule por escrito, atento el deber de diligencia e iniciativa que le impone el Art. 79 de la LCT.

3) El criterio expuesto en el punto anterior también es aplicable en los casos de relaciones laborales que no prevén la figura del contrato de trabajo de tiempo parcial, p.ej: Personal de la Industria de la Construcción Ley 22.250, Régimen de Trabajo Agrario Ley 22.248, etc, cuando media una jornada reducida en virtud de la cual, el trabajador devenga una remuneración mensual inferior a $ 1.708,24.-

4) Si, por motivos circunstanciales, durante el periodo mensual no se devenga la remuneración completa (casos de ingreso o egreso en fecha no coincidente con la primera o ultima del mes, licencias sin goce de haberes, suspensiones por causas disciplinarias, ausencias injustificadas o sin aviso y, en general, cualquier causa imputable al trabajador debido a la cual no haya prestado servicios), los aportes y contribuciones con destino al Sistema de Obras Sociales se calcularan sobre la remuneración mensual efectivamente devengada, cualquiera fuere su importe.
